Privacy Policy

Controller: Moments LLC (“Dark,” “we,” “us,” “our”)

This Privacy Policy explains how we collect, use, disclose, and protect information when you use Dark’s mobile application, website, and related services (the “Services”). By using the Services, you agree to this Policy.

Dark is intended only for adults 18+. We display an age-gate on entry. We do not perform identity verification (KYC). Content involving or exploiting minors is strictly prohibited and will be reported to authorities.

1) Scope & Third-Party Links

This Policy applies to personal data collected through our app and website, regardless of your country. The Services may include links or integrations to third-party sites, plug-ins, SDKs, or features. Those third parties process data under their own privacy policies; please review them.

Virtual Partners. If you provide services on Dark as a Virtual Partner (the provider role on our platform), a separate Virtual Partner Privacy Notice applies covering onboarding, payouts, taxation, and other provider-specific processing.

2) Information We Collect

We collect information you provide directly and automatically via your device. Categories include:

  • Account & Contact: alias/username, password or auth token, email; optional phone for login/recovery.
  • Profile: photos you upload, bio, interests, connection preferences.
  • Content & Communications: messages, photos, videos, voice notes, gifts sent/received, date proposals/schedules you create in the app.
    • Live calls: Dark does not record audio or video calls.
  • Purchase & Subscription Data: in-app purchase confirmations from Apple/Google; web checkout confirmations from our payment processors. We do not store full payment card numbers.
  • Device & Usage: IP address, device/OS, app version, language, time zone, session timestamps, features used, diagnostic/crash logs.
  • Approximate Location: inferred from IP for safety, language, pricing, and compliance. We do not collect precise GPS unless you enable a feature that needs it.
  • Support & Safety: reports you file, our responses, and policy-enforcement history.
  • Marketing & Communications Preferences: your choices about service messages and marketing (where applicable).
  • Aggregated/De-identified Data: statistics that do not identify you.

Special-category data (EEA/UK). Because Dark enables sensual/erotic chat and imagery, content you share may reveal sex life or sexual orientation. Where required, we process such data based on your explicit consent (e.g., when you upload or share it). You can withdraw consent in Settings; this does not affect prior lawful processing.

If you fail to provide information. Where we must collect certain data by law or to perform a contract with you (for example, basic account or payment information) and you do not provide it when requested, we may be unable to provide some Services. We will tell you at the time if this applies.

User contributions and visibility. Some profile elements you upload (e.g., display photo, bio) may be visible to other users. Private chats are not public, and calls are not recorded by Dark. However, recipients can always copy, capture, or re-share what you send. Please share responsibly.

3) How We Collect Data

  • Direct interactions: account creation, profile edits, purchases, support requests, feedback, surveys.
  • Automated technologies: cookies, mobile identifiers, and SDKs (see Section 5) collect device/usage data as you interact with the Services.
  • Third parties: app stores, payment processors, analytics/diagnostics providers, and deep-link/attribution providers may send us data needed to operate the Services.

4) How We Use Information (Purposes & Legal Bases)

We use information to:

  • Provide, personalize, and operate chat, live calls, virtual dates/gifts, and subscriptions.
  • Authenticate users; maintain security; prevent fraud/abuse.
  • Process payments and in-app purchases; send receipts and status notices.
  • Troubleshoot, analyze, and improve performance and reliability.
  • Communicate about service updates, policy changes, and support.
  • Comply with legal obligations and enforce our Terms.

Legal bases (EEA/UK). We rely on contract (to deliver the Services), consent (e.g., special-category content; certain notifications), legitimate interests (safety, anti-fraud, proportional analytics), and legal obligation.

5) Cookies, SDKs & Similar Technologies

What we use them for. To keep you signed in, remember preferences, measure usage/performance, diagnose crashes, and combat fraud.

SDKs in use.

  • Firebase (analytics, crash reporting)
  • Appsflyer (install attribution/campaign measurement)
  • Sentry (error/performance monitoring)
  • Facebook SDK (deep-linking/attribution/analytics)

We configure these providers so they do not use data for their own advertising and so that we do not “sell” or “share” personal information for cross-context behavioral advertising. You can manage tracking/attribution via OS settings (e.g., “Allow Apps to Request to Track” on iOS). Refusing essential technologies may affect functionality.

Third-party advertising. Dark does not run third-party ad networks or serve interest-based ads in the app. If this changes, we will update this Policy and provide required opt-outs.

6) Do Not Track

Some browsers offer “Do Not Track” (DNT). Because there is no industry standard for DNT, Dark does not respond to these signals. We provide other controls in this Policy and your device settings.

7) Sharing & Disclosure

We may share information with:

  • Service providers/Processors under contract (hosting/CDN, storage, analytics/diagnostics, messaging/email/SMS, content delivery, payment processing, customer support).
  • Other users when you choose to share (messages, media, gifts, date proposals).
  • Corporate transactions in mergers, acquisitions, or asset transfers, subject to this Policy.
  • Legal & Safety to comply with law, protect users, enforce policies, or address security issues.

Categories disclosed for business purposes may include: Identifiers, Commercial/Transaction data, Internet/Device data, Profile/Inference data, Content you share, and Support/Safety data.

We do not sell personal information and we do not “share” it for cross-context behavioral advertising under the California Consumer Privacy Act (as amended by CPRA).

8) Payments

  • In-App Purchases: Apple App Store / Google Play handle billing. We receive purchase confirmations, not full card data.
  • Web Card Payments: processed by third-party payment processors that receive card details directly and provide us tokens/receipts. We do not store full card numbers.

9) Safety & Moderation

We do not run automated content filters or proactive scanning. We handle user reports, enforce our policies, and comply with lawful requests. Zero tolerance for CSAM/exploitation; we report to authorities as required. Calls are not recorded.

Our app is designed for adult users (18+) only. We prioritise user safety and respectful communication.

  • User behaviour: Harassment, hate speech, or sharing of explicit or harmful content is strictly prohibited.
  • Moderation: Users can report inappropriate profiles or messages directly in the app. Our moderation team reviews all reports and may suspend violators.
  • Data protection: We never share or sell user data.

10) Data Retention & Deletion

  • Account, profile, purchases: retained while your account is active and as needed for legal/accounting purposes.
  • Messages & media: retained while your account exists.
  • When you delete your account: we delete your profile, content, and messages; disaster-recovery backups are cleared within 60 days of deletion.
  • Minimization: where possible, we aggregate or de-identify data for analytics and product improvement.

We may retain limited data to comply with law, resolve disputes, and enforce agreements.

11) International Data Transfers

We process data in the United States and other countries where we and our providers operate.

  • EEA/UK/Switzerland: When transferring personal data, we use Standard Contractual Clauses and implement appropriate safeguards.
  • Canada notice: Personal information may be processed in the U.S. and be accessible to law enforcement under U.S. law.

We have not appointed an EU/UK representative at this time; EEA/UK users may contact us directly (Section 17).

12) Your Rights & Choices

Your rights depend on your location and may include access, correction, deletion, restriction, objection, portability, and withdrawal of consent (where applicable).

How to exercise your rights. Use in-app controls or email support@darkgfe.com. We may request information to verify your identity and will respond within the timelines required by applicable law. If your request is denied, you may appeal by replying to our response or emailing support@darkgfe.com with “Privacy Appeal” in the subject line.

California (CPRA). You may request access, deletion, and correction, and limit use/disclosure of sensitive personal information to service delivery. We do not sell or share personal information for cross-context advertising.

Other U.S. States (e.g., CO, CT, VA, UT). You may have rights to access, delete, correct, port, and opt out of targeted advertising, sale, or certain profiling. Appeal rights apply as above.

Shine the Light (CA Civ. Code §1798.83). We do not disclose personal information to third parties for their direct marketing.

Nevada. We do not sell personal information; Nevada sale opt-out does not apply.

13) Accessing, Correcting, and Deleting Your Information

You can review and update certain account/profile information in-app. To exercise data rights (access, correction, deletion, portability) or withdraw consent where applicable, contact support@darkgfe.com.

  • We may ask for information to verify your identity.
  • Deleting your account removes your profile, content, and messages; backups clear within 60 days.
  • We may decline requests where an exception applies (e.g., legal obligations) and will explain why.

14) Security

We use administrative, technical, and physical safeguards appropriate to the nature of the data (encryption in transit, least-privilege access, logging, secure development practices). No method is 100% secure. You are responsible for maintaining the confidentiality of your login credentials and for what you share in chats or on your profile.

15) Children's Privacy

Dark is not directed to individuals under 18 and we do not knowingly collect personal data from them. If we learn we collected data from someone under 18, we will delete it.

16) Changes to This Policy

We may update this Policy to reflect changes in our practices or the law. We will update the “Last updated” date and, where required, notify you or request new consent.
