Terms of Use

1) Overview & Acceptance

These Terms of Use (“Terms”) are a binding agreement between you andMoments LLC (“Dark,” “we,” “us,” or “our”) governing your access to and use of the Dark mobile application(s), website(s), and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms and to our Privacy Policy (incorporated by reference). If you do not agree, do not use the Service.

Adults only (18+). You must be at least 18 years old (and the age of majority in your jurisdiction) to use the Service. We prohibit any content involving minors and will terminate and report violations.

Updates. We may update these Terms from time to time. The “Last Updated” date shows the latest version. Your continued use after changes become effective means you accept the revised Terms.

3) What Dark Is (and Isn't)

Virtual companionship. Dark enables consenting adults to connect withVirtual Partners for private, online interactions - chat, media exchange, virtual gifts, and scheduled video sessions (“Virtual Dates”) - conducted entirely within the Service.

No in-person facilitation. The Service does not arrange or facilitatein-person meetings, escorting, or sexual services. Requesting, promoting, or arranging offline encounters via the Service is prohibited.

No public content catalog. Interactions occur in private chats. We do not list or promote categories of content; however, all use must comply with these Terms and applicable law.

4) Accounts & Eligibility

  • Registration. Provide accurate information and keep it current. Certain features may require verified payment details.
  • Security. You’re responsible for your credentials and all activity on your account. Tell us promptly about any unauthorized access.
  • Age Gate. You must confirm you’re 18+ to proceed.

5) Subscriptions, Gifts & Payments

Subscriptions. We may offer auto-renewing subscription plans that unlock features (e.g., expanded chat, priority access, advanced interaction tools). Plan details, prices, and availability can vary by region/platform and may change; see in-app disclosures.

Virtual gifts & à-la-carte purchases. You may purchase virtual gifts or similar digital items via credit card (processed by our authorized processors or app store, as applicable). Virtual items have no cash value, are non-transferable, and are non-refundable except where required by law.

Billing & renewals. You authorize Dark and/or our processors to charge your selected payment method for fees, taxes, and charges. Subscriptions auto-renew until canceled. After canceling, you’ll retain access through the end of the paid period.

Refunds. Unless required by law or by applicable app-store policies, all sales are final and non-refundable. See Section 6 for Virtual Date cancellation specifics.

Chargebacks & fraud. Initiating a chargeback without contacting support may result in suspension or termination and we may seek recovery (including reasonable administrative and collection costs) as permitted by law.

6) Virtual Dates: Scheduling, Cancellation & No-Show

  • Scheduling. Virtual Dates are booked in-app. The confirmed time, duration, and any session parameters appear at booking.
  • Your cancellation. If you cancel within 24 hours of the scheduled start, no refund/credit is provided. If you cancel 24+ hours before the start, we may (at our discretion) reschedule or issue a service credit; cash refunds are not provided unless required by law.
  • Partner no-show/cancellation. If a Virtual Partner cancels or fails to appear, we will reschedule or provide a service credit at our discretion.
  • Technical issues. If Dark-side technical issues prevent a session from taking place, we will reschedule or provide a service credit at our discretion.

7) How to Cancel Auto-Renewing Subscriptions

Because app stores control billing, you must manage/cancel there:

  • iOS (Apple): Open Settings → tap [your name]Subscriptions → select Dark – Girlfriend Experience Cancel.
  • Android (Google Play): Open Google Play → tap profile icon Payments & subscriptions Subscriptions → select Dark – Girlfriend Experience Cancel.

We can’t cancel store-billed subscriptions on your behalf.

8) User Content & Permissions

Your content. You may submit text, images, audio, and video that comply with these Terms and the law. You grant Dark a worldwide, non-exclusive, royalty-free license to host, store, transmit, display, and adapt your content as needed to operate and improve the Service.

Illegal or harmful content is prohibited. This includes any material involving minors, non-consensual activity, exploitation, threats, harassment, or IP infringement.

No capture or redistribution. You may not record, copy, screen-capture, re-stream, or distribute any session or media from the Service without all required permissions. We deploy technical measuresdesigned to block screenshots and screen recording; circumvention is strictly prohibited and may lead to immediate termination and legal action. (No technical measure is perfect; you use the Service with that understanding.)

9) Virtual Partners (Independent Creators)

Virtual Partners are independent creators, not employees or agents of Dark. Additional Creator Terms (covering payouts, tax status, schedules, content, and compliance) apply to Virtual Partners and will be presented in-app.

KYC/age verification. All Virtual Partners must pass Dark’s KYC and age verification process. Users (non-Partners) are required to pass only the 18+ gate unless otherwise required by law.

10) Safety, Reporting & Enforcement

Prohibited conduct. You agree not to: (a) promote or arrange in-person encounters; (b) request/share illegal content; (c) harass, threaten, dox, or stalk; (d) misrepresent your age/identity; (e) spam, scam, or distribute malware; (f) attempt to bypass access controls, fees, or technical protections; or (g) interfere with the Service.

Private chats; no category listings. Dark does not pre-screen or list content categories. Nevertheless, all users must comply with law and these Terms. You can report any content or behavior that violates our policies using in-app reporting tools or by contacting support@darkgfe.com. We may remove content, warn, suspend, or terminate accounts and, where appropriate, cooperate with law enforcement.

11) Intellectual Property

The Service (including software, design, logos, and brand elements) is owned by Moments LLC or its licensors and protected by IP laws. Except for rights expressly granted to you under these Terms, all rights are reserved.

12) Third-Party Services

We may integrate or link to third-party services (e.g., video APIs, payment processors). Those services are governed by their own terms and privacy policies. We aren’t responsible for third-party actions or omissions.

13) App-Store Terms

If you downloaded the app from Apple’s App Store or Google Play, their terms govern purchases, renewals, and refunds. Apple/Google are not responsible for providing the Service or support. They may be third-party beneficiaries of certain license terms.

14) Disclaimers

The Service is provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. You are solely responsible for your decisions and interactions online.

15) Limitation of Liability

To the maximum extent permitted by law, Moments LLC and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages; loss of profits, revenues, data, or goodwill; or personal injury or emotional distress arising from or related to your use of the Service. Our total cumulative liability for any claim will not exceed the greater of (a) amounts you paid to Dark in the 12 months before the claim; or (b) USD $100. Some jurisdictions do not allow certain limitations; some terms may not apply to you.

16) Indemnification

You agree to defend, indemnify, and hold harmless Moments LLC and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your User Content, your use of the Service, or your breach of these Terms or applicable law.

17) Suspension & Termination

We may suspend or terminate your account (and/or remove content) at any time for any reason, including suspected violations, fraud/chargebacks, safety concerns, or legal compliance. You may stop using the Service at any time. Sections intended to survive termination (e.g., IP, payments, disclaimers, liability limits, indemnity, dispute resolution) will remain in effect.

18) Dispute Resolution (U.S. Users): Arbitration & Class Waiver

Informal resolution first. Contact support@darkgfe.com so we can try to resolve disputes informally within 30 days.

Binding arbitration. Except for small-claims court or where prohibited by law, any dispute arising out of or relating to these Terms or the Service shall be resolved by binding arbitration on an individual basis, administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.

  • Seat/Governing Law: Delaware law governs (without regard to conflicts rules).
  • Venue/Format: Hearings may occur virtually or, if in person, in Delaware, unless both parties agree otherwise.
  • Class/Jury waiver: No class actions or class-wide arbitration. You and Dark waive the right to a jury trial.
  • Injunctive relief: Either party may seek limited injunctive relief in court to protect IP/confidentiality or to prevent unauthorized recording/redistribution.

EEA/UK notice. If you are an EEA/UK consumer, mandatory arbitration/class waivers may not apply under local law; your statutory rights remain unaffected.

19) Geographic Restrictions & Compliance

You are responsible for ensuring your use is legal in your location. We may restrict access in certain countries/regions or as needed to comply with sanctions, export controls, or local law.

20) Privacy

Our Privacy Policy explains what data we collect and how we use it (including for safety, payment processing, and personalization). The policy will be available in-app and at darkgfe.com. Please review it carefully.

21) Communications

You consent to receive service-related emails and in-app messages (e.g., transactional, safety, policy updates). Where required, we’ll seek consent for marketing messages; you can opt-out per message instructions.

22) Miscellaneous

  • Governing Law & Venue. These Terms are governed by Delaware law (conflict-of-law rules excluded). For court claims not subject to arbitration or small claims, the state or federal courts in Delaware have exclusive jurisdiction.
  • Entire Agreement. These Terms (plus policies referenced) are the entire agreement between you and us regarding the Service.
  • Severability. If any provision is unenforceable, it will be limited or severed to the minimum extent necessary; the remainder remains in force.
  • Assignment. You may not assign these Terms without our consent. We may assign them (e.g., in a merger, sale, or reorganization).
  • No waiver. Failure to enforce a provision is not a waiver.
